On February 15, 2026, a 60-day notice of intent to sue was filed by Clean Product Advocates, LLC (CPA) through Cliffwood Law Firm, PC. The notice names Bumble Bee Foods, LLC; Snow Food, LLC; and Walmart Inc. as alleged violators and identifies a specific product category and exemplar product that CPA says is being sold to California consumers without required warnings.

The product category identified in the notice is “Snows Wild Caught Served in Clam Juice Chopped Clams.” The exemplar product specified by CPA is Snows Wild Caught Served in Clam Juice Chopped Clams, UPC # 798525161008. CPA states the product was manufactured or distributed by Bumble Bee Foods, LLC and Snow Food, LLC and offered for sale by Walmart Inc. in California.

CPA alleges that the products expose consumers to the chemicals lead and cadmium and that these exposures have occurred without the clear and reasonable warnings required under California’s Safe Drinking Water and Toxic Enforcement Act of 1986. The notice states that the route of exposure for the identified chemicals is ingestion and summarizes the effects associated with those chemicals as cancer, birth defects, and other reproductive harm. The notice indicates exposures have occurred dating as far back as August 16, 2025 and would continue until appropriate warnings are provided or the chemicals are removed from the products.

Under the statute cited in the notice, a private party must provide a 60-day notice before filing a private enforcement action unless a public prosecutor initiates an enforcement action. CPA’s notice informs the identified recipients and public prosecutors that it intends to bring an enforcement action after the 60-day notice period unless public enforcement agencies commence and diligently prosecute an action to address the alleged violations.

The notice lists specific remedies CPA seeks to obtain through an enforceable written agreement or through litigation. Those requested measures include: (1) a recall of the listed products to eliminate further exposures to the identified chemicals; (2) affixing clear and reasonable warning labels to the products sold in the future or reformulating the products to eliminate the exposures; and (3) payment of applicable civil penalties and the costs associated with bringing the action.

The filing includes a Certificate of Merit executed by the filing attorney attesting that she consulted with persons with appropriate experience or expertise who reviewed facts, studies, and other data regarding the alleged chemical exposures, and that she believes there is a reasonable and meritorious case for private action based on those consultations and information in her possession. The notice also indicates that factual information sufficient to establish the basis of the certificate of merit was provided to the Attorney General as required by the statute.

CPA’s notice was served on the identified companies and provided to numerous California district attorneys and city attorneys, as reflected in an attached distribution list. The notice also attaches a summary prepared by the California Office of Environmental Health Hazard Assessment describing the statutory provisions and certain compliance exemptions and requirements.

The notice invites the named recipients to communicate with CPA’s attorneys if they seek an early resolution to avoid litigation. It identifies the product category and an exemplar UPC to assist investigation and states the exemplar is not intended to be an exhaustive identification of all potentially affected products.
